General Terms and Conditions of Sale (T&Cs)

1. Purpose

These General Terms and Conditions of Sale (T&Cs) apply to any order placed on the website www.moment-event.lu by a customer for photobooth rentals and related services. They define the rights and obligations of the parties within the scope of the sale of these services. www.moment-event.lu par un client, pour la location de photobooth et les services associés. 3. Description of Services

Moment offers:

  • Photobooth rental, including delivery, installation, dismantling, technical support, accessories (backdrops, costume props), photo paper, and a link to an online gallery after the event. These photos are available for one month following the event.
  • Creation of balloon arches and structures.
  • Audio guestbook rental, including the phone, an explanatory frame, a decorative neon sign, and audio recordings provided in MP4 format after the event.
  • Rental of event-related equipment, upon request and with a quote.

Each service is detailed on our website and in the quotes provided to the client.

4. Orders and Acceptance of the T&Cs

Placing an order via www.moment-event.lu or by other means implies the customer's unconditional acceptance of these T&Cs. No special conditions, unless expressly agreed upon in writing by Moment, can prevail over these T&Cs. www.moment-event.lu ou par d’autres moyens implique l'acceptation sans réserve des présentes CGV par le client. Aucune condition particulière, sauf accord écrit de Moment, ne peut prévaloir sur les CGV.

5. Pricing and Payment Terms

  • Price Prices are quoted in euros, excluding VAT. The applicable price is the one in effect on the day of the order.
  • Payment: A 20% deposit is required upon signing the quote. The balance must be paid 4 days before the event.
  • Late Payment Penalties: A 10% penalty will apply for late payments.
  • Non-Payment Clause: In case of non-payment 4 days before the event, Moment S.à.r.l. reserves the right to unilaterally cancel the service.
  • Accepted Payment Methods: Bank transfer.

6. Cancellation and Modification

In case of cancellation by the client:

  • Up to 15 days before the service: full refund of the deposit.
  • Less than 15 days before the service: the deposit is non-refundable.

Any modifications (date, location, time) must be communicated in writing at least 30 days before the event and will be subject to Moment S.à.r.l.'s availability.

7. Security Deposit

A €1,500 deposit per photobooth is required. This deposit will be:

  • Held: The amount will be retained via bank transfer before the service.
  • Refunded via bank transfer: After verification of the equipment at the end of the rental, provided no damage or loss is noted.
  • Deducted: In case of damage, the necessary repair or replacement costs will be deducted from the deposit.

The deposit must be paid no later than 4 days before the event.

8. Delivery and Installation

The photobooth is delivered and installed at the address provided by the client.

  • Access Conditions: The client must ensure that the location is accessible and suitable for photobooth installation (parking space, surface area, electrical supply, etc.).
  • Responsibility: The client is responsible for supervising the equipment during the event.

9. Usage and Responsibilities

The client is responsible for the proper use of the photobooth. In case of damage caused to the equipment by the client or guests, repair or replacement costs may be charged.

10. Warranty and Support

Moment guarantees a photobooth in perfect working condition. Assistance is available during the event for technical support at contact@moment-event.lu. contact@moment-event.lu..

11. Right of Withdrawal

In compliance with applicable legislation, the client has a 14-day withdrawal period after placing the order, unless the service is to be performed before the end of this period. In such cases, the right of withdrawal does not apply.

12. Personal Data Protection

Personal data collected during the order process is necessary for managing and providing services, in compliance with the General Data Protection Regulation (GDPR). The client can exercise their rights to access, rectify, or delete their data by contacting contact@moment-event.lu..

13. Image Rights

By providing a photobooth that captures photos, Moment S.à.r.l. transfers the image rights for the photos to the client, who assumes responsibility for image rights. Moment S.à.r.l. retains access to the data and photos captured by the client and stores them for one month after the photobooth is returned, allowing the client to retrieve them if they have not done so during the rental period. After this time, Moment S.à.r.l. commits to delete the data and photos stored by the photobooth.

The client agrees to comply with legal provisions relating to the image rights of all photobooth users. Moment S.à.r.l. cannot be held liable for the dissemination of photos taken by the photobooth and subsequently shared on social media or other platforms by users or any individuals who accessed them.

14. Governing Law and Jurisdiction

These T&Cs are governed by Luxembourg law. Any disputes relating to their interpretation or execution will be subject to the exclusive jurisdiction of the courts in Luxembourg.
